While in Thailand, foreigners are not allowed to work unless they have a work permit. Working in the Kingdom without a permit carries criminal penalties ranging from fines to imprisonment. Therefore, it is worth making an effort to get such permission for yourself. Here's what you need for this.

Steps

  1. 1 Take care of your employment in Thailand first. This can be done in two ways:
    • Open your business in Thailand. Since foreigners in the Kingdom are not allowed to register a business for themselves, you need to find a local business partner. Officially, this will be his business, and you will be a foreign investor.
    • Find an employer in Thailand. The Kingdom's government imposes rather stringent requirements on companies wishing to hire a foreign worker:
      • The company must have a registered capital of at least 2 million baht per immigrant and adhere to the requirements for the ratio of Thai to foreign personnel (which depend on the type of activity, but as a rule, this ratio is 4 to 1 or 7 to 1). The authorized capital does not have to be in monetary form; these can be assets on the company's balance sheet, such as a car, computers, equipment, and so on.
      • If the foreign worker has a Thai spouse, it is sufficient that the registered capital is 1 million baht per foreigner.
      • Foreigners who have their own business in Thailand can obtain work permits for their employees as long as they each bring at least 3 million baht into the country. A maximum of 10 permissions can be obtained.
      • The company must be registered as a payer of VAT or other tax.
  2. 2 Get a Category B Nonimmigrant Visa.
    • Contact the Thai Embassy in your country.
    • Alternatively, change from a tourist visa to a nonimmigrant visa while in Thailand. To do this, contact the Immigration Department in Bangkok.
  3. 3 An employer or business partner must apply to the Thai Ministry of Labor for a work permit for a foreign employee or associate and provide the required documents. A list of documents is given below in the "What you need" section. It will take 7 business days to review the permit application. The permit application is processed at the office of the Ministry of Labor. If you are qualified and able to use the One Stop Service Center, it will take only one day to process a work permit.
  4. 4 Sign your Thailand work permit. You must be present at the Ministry of Labor in person with your passport and sign a work permit in Thailand in the presence of employees of the Department of Labor. When you receive your permit, the Labor Department will stamp the end of your passport.
  5. 5 After obtaining a work permit, go to the Revenue Department and receive a tax ID card. This is a plastic card the size of a driver's license, but without a photo. The taxpayer card will show your personal tax identification number, which is required in Thailand to receive your salary in the accounting department.

What do you need

The applicant must provide the following documents:


  • Three 4 x 5 cm color photographs in regular format
  • Medical certificate confirming your good health
  • Original passport along with copies of the passport cover page (personal data and photograph), pages with a valid visa and pages with an entry stamp
  • Letter of invitation to work
  • Diploma corresponding to the vacancy
  • Legal address of residence in Thailand.
  • Work permit application forms
  • Departure card TM.6
  • Resume with details of past positions, responsibilities, achievements, duration and places of work of the applicant
  • If the applicant is married to a Thai citizen / citizen: marriage certificate as well as Thai spouse ID card, children's birth certificates and household registration

The employer must provide the following documents:

  • Certificate of registration of the company and its purpose
  • Factory license (if required) issued by the Factory Department of the Ministry of Industry
  • List of shareholders certified by the Commercial Registration Department
  • VAT certificate - Phor Phor 20
  • Withholding VAT - Phor Phor 30
  • Income tax - Phor Ngor Dor 1
  • Workers' Social Security Certificate
  • Financial statement, copy of bank documents of the employing company, confirming the presence or contribution to the authorized capital of 2 million baht and / or other documents;
  • A photocopy of the director's passport and work permit with an attached signature
  • Office map (plan).
  • Letter of employment stating the position and salary of the applicant
  • Labor contract

Warnings

  • If you filed a resignation letter or were fired by the company, you must return your work permit to the Department of Labor within 10 days.
